Booking Conditions for Morzine Catered and Self Catered Chalets
balance means the booking price minus any payments made.
booking means the contract between Mountain Spaces and the lead guest comprising of the booking form, acceptance of the terms and conditions, booking confirmation and the booking price.
booking confirmation means the correspondence sent to the lead guest confirming that Mountain Spaces has accepted and confirmed the booking.
booking form means the form supplied by Mountain Spaces to be completed by the lead guest containing the details of the booking and the booking party
booking party means the group of people the lead guest is making the booking for including the lead guest
booking price means the total price for the holiday as described on the booking form
deposit / non-refundable deposit means the amount paid by the lead guest at the time of returning the booking form
holiday means a period of time during which the booking exists.
lead guest means the guest in whose name a booking has been made
provisional booking means the temporary reservation of a holiday booking
we or us means Mountain Spaces SARL

1.1 From the time of requesting to book a holiday a provisional booking will exist for 48 hours. During this period you must complete and return the booking form and pay the non-refundable deposit. It is at our discretion whether or not to extend or cancel a provisional booking beyond this period.
1.2 If the start date of your holiday is less than 10 weeks from the time of requesting to book a holiday the full amount will be required to secure your booking.
1.3 A confirmed booking does not exist until the lead guest has returned the signed and completed booking form along with the required non-refundable deposit, acceptance of the terms and conditions and Mountain Spaces has confirmed acceptance of the booking by sending the lead guest booking confirmation.
1.5 We do not guarantee to notify you of the cancellation of a provisional booking and once a provisional booking has been cancelled the holiday dates will be re-offered for sale.
1.6 It is at the sole discretion of Mountain Spaces whether or not to confirm a booking.
1.7 You must read the terms and conditions carefully before signing and returning the booking form.
1.8 Only persons named on the booking form are permitted to enter the chalet or use any of the facilities.
2.0 PAYMENT TERMS
2.1 The booking price shall be payable in the currency stated on the booking form. The currency of the booking price may not be altered once a booking has been confirmed.
2.2 Payment can be made by bank transfer, Credit or Debit Card. We accept Visa or MasterCard. For Euro payments the GBP Sterling amount that you are charged will be based on your banks exchange rate at the time of payment and we can not be held responsible for any fees your bank or card provider charges you. Any price shown in a currency other than Euros is indicative only.
2.3 The non-refundable deposit of 30% must be paid to secure a booking unless the holiday start date is less than 10 weeks from the time of booking, in which case the full balance shall be due.
2.4 Balance Payments – The balance payment shall be due 10 weeks before your holiday. If the balance payment is not received we reserve the right to cancel your holiday, apply the relevant cancellation charges and re-offer the holiday for sale.
2.5 Lift passes – Lift passes are payable in Euros only and we reserve the right not to issue pre-ordered lift passes until payment has been received in full. Payment for pre-ordered lift passes is due two weeks before arrival.
2.6 Airport transfers – Airport transfers are payable in Euros only, we reserve the right to not book or carry out transfers until payment has been received in full. Payment for airport transfers is due two weeks before arrival.
2.7 The lead guest will be liable for the full payment of outstanding sums including but not exclusively the holiday balance payment, lift passes and airport transfers. If the balance payment is not received on the date due Mountain Spaces has the right to cancel your booking and retain the deposit paid and levy cancellation charges. Mountain Spaces reserve the right to re-sell the holiday without notice to the lead guest.
3.0 INSURANCE AND SECURITY DEPOSIT
3.1 Mountain Spaces may require a security deposit to cover any additional costs or damage to a chalet during your holiday. This must be in the form of valid credit or debit card details that will be pre-authorised before your arrival and will be cancelled at the latest 10 days from your check out.
3.2 This includes additional cleaning costs if the chalet is not left in the state as described in the security deposit form.
3.3 Mountain Spaces cannot guarantee to check and validate any damages or the condition of the chalet until 48 hours after your departure and any damage resulting in the need to obtain a quote or price for repair may result in the pre-authorisation taking longer than 10 days to cancel.
3.4 Any additional costs incurred will be charged to the pre-authorised card, in the event of the pre-authorisation amount not being sufficient to cover the additional cost the lead guest will be invoiced and any outstanding sums will be payable immediately.
3.5 It is a condition of booking that every guest is covered by personal holiday or travel insurance sufficient to cover each guest adequately for third party risks and damage, accidental or otherwise to the chalet caused by members of your group mentioned on the booking form or by visitors to your group in the chalet.
3.6 We may ask for details of your cover in conjunction with payment of the security deposit.
3.7 Failure to secure the chalet by locking or closing doors or windows leading to theft or damage of Mountain Spaces equipment or the chalet itself will result in the cost being deducted from the security deposit.
4.0 BOOKING AMENDMENTS AND CANCELLATIONS
4.1 If you wish to cancel a booking, a request must be made in writing to us from the lead guest. Cancelling a booking will result in a €50 cancellation fee plus the following charges:
More than 10 weeks before your holiday – loss of deposit
Less than 10 weeks before your holiday – 100% of the total holiday cost
4.2 Any sums outstanding will become immediately payable to Mountain Spaces.
4.3 It shall be entirely at the discretion of Mountain Spaces whether to allow any changes or amendments to a booking, including but not exclusively, dates, number of guests, property and any other holiday details contained in the booking form or agreed at the time of booking.
4.4 In the case of a booking being amended Mountain Spaces reserve the right to remove any discounts or reductions applied to the original booking.
4.5 In the case of Mountain Spaces amending the dates or property for a booking the lead guest will be given the choice of changing to the amended booking or receiving a full refund. The lead guest must confirm their choice within 7 days or it will be assumed that the suggested amendment has been accepted.
5.0 TAXE DE SEJOUR
5.1‘Taxe de sejour’is a local tax levied by the municipal council of Morzine-Avoriaz on a per night basis for all guests over the age of 18 years old staying one or more nights. This tax is not controlled by Mountain Spaces and is subject to change but will be clearly indicated on your booking form and will be payable two weeks before your arrival.
5.2 It is the lead guests responsibility to correctly declare the number of guests in their party over the age of 18.
6.0 LIFT PASSES
6.1 Lift passes may be pre-ordered by phone, email or requested on our booking form. The full amount is payable in accordance with our standard payment terms two weeks before arrival, lift passes will not be issued until payment is received in full.
6.2 If you wish to cancel a lift pass order you must inform us in writing, lift pass orders can only be cancelled or amended less than two weeks before your holiday at the sole discretion of Mountain Spaces.
7.0 AIRPORT TRANSFERS
7.1 Airport transfers may be pre-ordered by phone, email or requested on our booking form. The full amount is payable in accordance with our standard payment terms two weeks before arrival, transfers will not be actioned unless payment has been received in full.
7.2 If you wish to cancel a transfer you must inform us in writing, transfers can only be cancelled or amended less than two weeks before your holiday at the sole discretion of Mountain Spaces. This does not apply to changes caused by delay or flight cancellation which will not incur any charges.
7.3 Airport transfers will be carried out by a suitable 3rd party registered and insured to carry paying customers in Switzerland and France and will be carried out in accordance with that 3rd parties terms and conditions.
7.4 Unless specifically stated airport transfers shall be on a shared basis.
8.0 SHARED AIRPORT TRANSFERS
8.1 Although every effort will be made to keep groups together, all passengers and luggage may not be transported in the same vehicle, leave from the point of departure at the same time, or arrive at the destination at the same time.
8.2 Passengers at the airport may have to wait a reasonable amount of time for passengers arriving on other flights to arrive and to clear customs and baggage reclaim.
8.3 Passengers arriving or leaving resort may travel via other passengers departure or arrival destinations.
9.0 PRIVATE TRANSFERS
9.1 All passengers and luggage will travel privately to and from departure and arrival points without transporting other passengers. Passengers may request to travel grouped in certain ways but we reserve the right to allocated passengers to specific vehicles.
9.2 Passengers will leave the airport as soon as is reasonably possible once their entire party has met the representative of the transfer company in the designated area.
10.0 ARRIVAL AND DEPARTURE
10.1 Check in to the chalet is from 16.00 on your arrival day and this is when your booking begins. If you arrive before this time we will try to store your luggage for you, but cannot guarantee secure storage of luggage and Mountain Spaces will not be liable for any lost or stolen items.
10.2 Check out from the chalet is at 10.00 on your departure day and this is when your booking ends. If you depart after this time we will try to store your luggage for you, but cannot guarantee secure storage of the luggage and Mountain Spaces will not be liable for any lost or stolen items.
11.0 HOT TUBS, SAUNAS AND LOG FIRES
11.1 Use of hot tubs and saunas, where provided, is at the sole risk of the guest and Mountain Spaces accepts no responsibility for accidents or injuries as a result of their use or misuse.
11.2 The water in our hot tubs is usually but not always changed once a week on changeover day, as such the water will not be warm for up to 15hrs from the time of check in at 16h00
11.3 Should any of these facilities develop a fault Mountain Spaces will endeavour to, but can not guarantee that the fault will be rectified during your stay and will not liable to compensate for any inconvenience.
11.4 Guests must read and follow the notices in the chalet regarding the hygienic use of hot tub and sauna facilities. The lead guest will be liable for any damage or additional cleaning caused by a failure to do so.
11.5 Mountain Spaces reserves the right to close the hot tub if it is apparent that it is being wilfully misused and/or the hygiene rules are not being followed. If this is this the case no compensation will be offered.
11.6 Only logs provided by Mountain Spaces are to be burnt on the fire, the fire must not be loaded with more than three logs at a time and the glass door must be kept shut when the fire is lit.
11.7 Ash must never be removed from the grate using a standard vacuum cleaner and ash must not be removed and placed in the rubbish until all ash is at room temperature.
11.8 The fire must be supervised at all times when lit.
12.0 RIGHTS OF REFUSAL
12.1 Mountains Spaces reserves the unconditional right to terminate a holiday with immediate effect in the event of unreasonable or inappropriate conduct by one or more of the booking party or persons invited into the chalet by the booking party.
12.2 Unreasonable or inappropriate conduct is defined as behaviour or actions that may cause damage or danger to property or other persons, customers or employees of the company.
12.3 In the event of a termination, full cancellation charges will apply and the company will not be responsible for, or compensate for any additional accommodation, transport or other incidental costs incurred by the guest or guests.
13.1 Mountain Spaces shall not be held responsible for damage or theft of any items or property held or left in any of our properties.
14.0 FORCE MAJEURE
14.1 Force majeure means any insurmountable natural or man made event or act of God beyond our control that prevents Mountain Spaces from fulfilling it’s obligations, including but not exclusively, fire, flood, riot, strike, industrial action, road closure, airport closure, severe weather conditions affecting driving conditions. Under such conditions Mountain Spaces shall not refund any deposits or balance payments or be liable for any expense or incidental costs incurred by a guest or caused by the failure of Mountain Spaces to fulfil the terms of the booking under these conditions. The guest alone shall be responsible for paying any costs including accommodation or onward travel.
15.1 Every effort has been made to describe all aspects of our properties and services accurately but we reserve the right to make minor changes at any time.
15.2 All photographs are either of, or are representative of our properties or services but we do not guarantee that properties or services will be exactly as described.
15.3 Any item or service that is not expressly mentioned as provided is included is at the discretion of Mountain Spaces. The company reserves the right to make major changes without notice and at any time unless a booking has been secured.
16.0 PRIVACY AND DATA PROTECTION
16.1 Any information or personal details we collect during the booking process or during your holiday will not be used for any other purpose other than booking and confirming your holiday and details. We will not pass your details on to any 3rd parties or companies unless you specifically instruct us to enable the booking of transfers, ski hire, lessons or other services or goods. All companies we work with operate similar privacy policies. Your contact details will only be kept for future correspondence with your permission.
